ONLINE PARKING TERMS AND CONDITIONS

1. Operator Details
The car park at Trinity Centre Aberdeen (“Car Park”) is operated by Burnett & Black Limited, as managing agent on behalf of the property owner.

References to “we”, “us” and “our” mean Burnett & Black Limited acting as managing agent. References to “you” mean the driver, registered keeper and/or owner of the vehicle and any person using the Service.
PART A – GENERAL CAR PARK TERMS
2. Use of the Car Park
2.1 The Car Park is available solely for the parking of private motor vehicles during advertised opening hours.
2.2 Parking charges apply from the moment of entry until exit.
2.3 You must:
– Park wholly within marked bays.
– Comply with all signage, tariffs, height restrictions and speed limits.
– Follow all reasonable instructions given by staff.
– Use designated bays only if entitled to do so.
– Ensure your vehicle is securely locked and all windows are closed before leaving it.
– Ensure children and persons under your supervision are properly supervised at all times.
2.4 Prohibited activities include:
– Carrying out mechanical work or cleaning vehicles.
– Selling, hiring or advertising vehicles.
– Towing vehicles into the Car Park without our consent.
– Parking for any unlawful purpose.
2.5 We reserve the right to refuse entry, or require removal, of any vehicle causing obstruction, nuisance, safety concerns or breach of these Terms.
3. CCTV and ANPR
CCTV and Automatic Number Plate Recognition systems operate for security, safety and parking management. ANPR data is processed for contract performance, legitimate interests in parking management, crime prevention and site security. Personal data is processed in accordance with UK GDPR and our Privacy Policy.
4. Parking Charges and VAT
4.1 Tariffs are displayed onsite and online.
4.2 All tariffs are inclusive of VAT unless otherwise stated.
4.3 We reserve the right to amend tariffs at any time.
4.4 VAT receipts are available upon request or via your online account where applicable.
5. Liability
5.1 The Car Park is a public place open to all users. Vehicles and their contents are parked at your own risk.
5.2 We do not guarantee the security of vehicles or their contents.
5.3 We shall be liable for loss or damage only to the extent caused by our negligence, wilful act, breach of statutory duty or default.
5.4 Nothing in these Terms excludes or limits liability for:
a) death or personal injury caused by our negligence;
b) fraud or fraudulent misrepresentation;
c) any liability which cannot be excluded under Scots law.
5.5 Subject to clause 5.4, we shall not be liable for indirect or consequential loss, loss of profit, revenue, business or anticipated savings, temporary service interruption or system failure, or loss or damage to vehicles or contents except where caused by our negligence.
5.6 Where liability is established, our total liability in respect of any single parking event shall not exceed £250 or such greater sum as required by law.
5.7 Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 as it applies in Scotland.
6. Lien, Removal and Abandoned Vehicles
6.1 We shall have a contractual lien over any vehicle parked in the Car Park in respect of all unpaid parking charges, interest, recovery costs and any other sums due. We may retain possession of the vehicle until payment is made in full.
6.2 We reserve the right to move, or arrange for the movement of, any vehicle within or from the Car Park where reasonably necessary to prevent obstruction, for safety or emergency reasons, for operational efficiency, or where the Car Park must be closed or evacuated.
6.3 If a vehicle remains in the Car Park for more than 28 consecutive days without prior notification and without valid ongoing payment, we may reasonably treat it as abandoned.
6.4 Before disposing of an abandoned vehicle, we will make reasonable enquiries to identify and contact the registered keeper and provide at least 28 days’ written notice of our intention to dispose of the vehicle.
6.5 We may arrange for removal, storage and sale of the vehicle in accordance with applicable Scottish law.
6.6 Parking charges shall continue to accrue for the entire period the vehicle remains onsite.
6.7 All removal, storage, sale and associated costs shall be recoverable from the vehicle owner and may be deducted from sale proceeds.
6.8 Any surplus proceeds remaining after deduction of all sums due shall be held for the registered owner upon proof of entitlement.
7. Complaints and Claims Procedure
7.1 If your vehicle is damaged, or you suffer loss while using the Car Park, you must inform a member of staff before leaving (where reasonably possible), report theft or criminal damage to Police Scotland and obtain a crime reference number, and notify your insurer promptly.
7.2 Any claim must be submitted in writing within 14 days of the incident including full details and supporting evidence.
7.3 Failure to follow this procedure may affect our ability to investigate the matter and may prejudice your claim.
PART B – ONLINE PAYMENT TERMS
8. Autopay
8.1 You must register accurate vehicle and payment details.
8.2 By registering, you authorise us to charge your registered payment method for all parking charges incurred.
8.3 If payment fails, you remain liable for the outstanding amount.
9. Pre-Book Parking
9.1 All bookings must be paid in full at time of booking.
9.2 Pre-booking guarantees entry during the booked period but does not guarantee a specific space.
9.3 Overstays will be charged at the prevailing tariff.
9.4 By booking for a specific date and time, you acknowledge that the statutory 14-day cooling off period does not apply once the booking period has commenced.
10. Debt Recovery and Interest
10.1 We reserve the right to recover unpaid sums.
10.2 Interest may be charged on overdue amounts at 4% above the Bank of England base rate, accruing daily from the due date until payment is made.
10.3 Where applicable, we reserve the right to claim statutory interest and reasonable recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998 in respect of business users.
11. Force Majeure
We shall not be liable for failure or delay in performing our obligations where such failure results from events beyond our reasonable control including fire, flood, power failure, industrial action, terrorism, governmental action or other unforeseen events.
12. Third Party Rights
No person who is not a party to these Terms shall have any right to enforce them.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Car Park or Service constitutes acceptance of the updated Terms.
14. Governing Law
These Terms and any non-contractual obligations arising out of them shall be governed by the laws of Scotland. The Scottish courts shall have exclusive jurisdiction.
